Abstract

The right to health is recognized as one of the fundamental pillars for preserving human
dignity and the full realization of citizenship. The 1988 Federal Constitution and the Unified
Health System (SUS) establish the normative and institutional foundation for promoting and
ensuring this right. However, the effective implementation of these guidelines faces significant
challenges, particularly concerning the specific needs of people with autism. The present study
aims to analyze the right to health for individuals with autism in Brazil, specifically emphasizing the role and effectiveness of the SUS. To achieve this objective, key legislation and public
policies related to the topic will be examined, assessing the effectiveness of interventions and
treatments provided by the public health system. The methodology combines literature review
and documentary research. The study concludes that although efforts are being made to en
sure the effectiveness of interventions within SUS, it is important to note that the scarcity of
resources allocated to the health sector significantly affects the treatment of ASD in the public
healthcare network. On the other hand, Brazilian legislation has made progress in securing the
rights of this population.
