Abstract

This theoretical essay aims to analyze the human rights and aging of people with disabilities, as guaranteed in the Statute of Persons with Disabilities and the Convention on the Rights of Persons with Disabilities, seeking to ensure a dignified life of equality, respect, and opportunities for elderly people with disabilities. The chosen method is historical-dialectical materialism, which allows for connections with social and historical reality, considering the material relations and internal contradictions of the aforementioned phenomenon. Bibliographic and documentary research were used. Initially, we will present the population increase of elderly people with disabilities and their challenges in the 21st century for aging with dignity. Next, an analysis of the process of aging and old age of people with disabilities is carried out, from a perspective of totality, breaking with the ahistorical homogenization attributed to the aging process, showing that it is not a homogeneous group, it is a unity in difference and with differences, that is, there is old age and old ages. The legal frameworks for protecting people with disabilities in Brazil, their advances, and challenges are discussed. It is concluded that there have been advances in Brazil in terms of social protection for elderly people with disabilities, but these rights need to be materialized.
